Our Chapter 13 Practice

We handle all matters related to a Chapter 13 proceeding, preparing and filing all documentation to complete the process, and acting as your representative in hearings or meetings with creditors, the bankruptcy trustee and the Court.

In a Chapter 13 bankruptcy, just like in a Chapter 7, you are granted an automatic stay, which prohibits your creditors from calling, writing or taking any other action to collect the debt. In exchange, you agree to repay your creditors over a 3 to 5 year period all or part of your debt, depending on the circumstances. If you keep your agreement, at the end of your plan you will receive a discharge of certain debts. If you miss payments, however, your case will be dismissed and you will lose the protections of the bankruptcy laws.

When you file for protection under Chapter 13, you are normally allowed to keep your assets. Often, the repayment plan will allow you to pay less than the total due on your unsecured debt such as credit card debt. Sometimes, a Chapter 13 plan will provide for no repayment on unsecured debt.
