Bankruptcy Lawyers in Cleveland, Ohio
Experienced Representation in Chapter 13 Filings
If you face serious financial problems and you don’t qualify to discharge your debts under Chapter 7 or you want to repay your creditors in full or in part, a Chapter 13 bankruptcy filing can help you get the fresh start you need. Reorganizing your debts under Chapter 13 can stop foreclosure proceedings on your home. You want an experienced attorney to guide you through the process, one who has successfully helped others use the bankruptcy laws to address financial challenges.
At the law office of Rabin & Rabin Co., L.P.A., we have over 30 years of experience handling bankruptcy petitions for consumers throughout northeast Ohio, including filings for reorganization under Chapter 13. We place a high priority on communication and accessibility, keeping you fully informed at all times and making ourselves available when you need to talk with us.
Our Chapter 13 Practice
We handle all matters related to a Chapter 13 proceeding, preparing and filing all documentation to complete the process, and acting as your representative in hearings or meetings with creditors, the bankruptcy trustee and the Court.
In a Chapter 13 bankruptcy, just like in a Chapter 7, you are granted an automatic stay, which prohibits your creditors from calling, writing or taking any other action to collect the debt. In exchange, you agree to repay your creditors over a 3 to 5 year period all or part of your debt, depending on the circumstances. If you keep your agreement, at the end of your plan you will receive a discharge of certain debts. If you miss payments, however, your case will be dismissed and you will lose the protections of the bankruptcy laws.
When you file for protection under Chapter 13, you are normally allowed to keep your assets. Often, the repayment plan will allow you to pay less than the total due on your unsecured debt such as credit card debt. Sometimes, a Chapter 13 plan will provide for no repayment on unsecured debt.
At Rabin & Rabin, we will represent you until you have completed the repayment plan. If you encounter problems during the course of your plan, you will contact us and we will be there to help you address the issues.
