Determining Eligibility For Chapter 13 Bankruptcy

To be eligible for Chapter 13 bankruptcy, you must have a source of regular income and less than certain amounts of secured and unsecured debts. Chapter 13 bankruptcy is a strong option for individuals with a steady source of income who struggle with debt but want to keep their assets.

For instance, a person who is behind on mortgage payments but wishes to keep their home may benefit from Chapter 13, which can halt foreclosure and allow for repayment of arrearages over time. Additionally, someone with significant unsecured debt who wants to retain valuable assets might find this a viable option.

In a Chapter 13 bankruptcy, just like in Chapter 7, you are granted an automatic stay, which prohibits your creditors from calling, writing or taking any other action to collect the debt. In exchange, you agree to repay your creditors over three to five years, paying either all or part of your debt, depending on the circumstances. If you keep your agreement, you will receive a discharge of certain debts at the end of your plan. If you miss payments, however, your case will be dismissed, and you will lose the protection of the bankruptcy laws.

When you file for protection under Chapter 13, you can typically keep your assets. Often, the repayment plan will allow you to pay less than the total due on your unsecured debt, such as credit card debt. Sometimes, a Chapter 13 plan will provide for no repayment on unsecured debt.
